After having separated from their spouse for more than one year some people believe that their divorce is automatic. This is not the case as you must apply to the court for a Divorce Judgment. It is only upon the issuance of the Divorce Judgment that the divorce is finalized.
Once you and your spouse have come to some form of agreement as to custody, access, child support, spousal support, and a division of the marital assets, your lawyer would then be able to to apply to the court to finalize your divorce. Provided that there is no disagreement between the parties, it will take approximately three months for the Divorce Judgment to issue. You may be able to avoid any court appearances if the information required by the presiding judge can be submitted in the form of affidavits.
